Powers of Attorney

An Enduring Power of Attorney is a legal document which allows you to appoint someone you trust to handle your financial affairs in the event that you are incapable of doing so.

It provides protection from your assets otherwise being frozen if you were to become incapacitated due to an accident, illness or disability.

It is important that an Enduring Power of Attorney is established whilst you are capable of managing your own affairs.

Common duties that your Attorney can perform on your behalf include, managing your bank accounts, paying bills, selling or renting your home and signing certain documents.

Appointment of Enduring Guardian

An Appointment of Enduring Guardian allows you to appoint someone you trust to make health and lifestyle decisions on your behalf in the event that you are incapable of doing so.

The existence of the document can make the process of dealing with Doctors and other health care providers much easier for your family.

Similar to a Power of Attorney, an Appointment of Enduring Guardian must be established whilst you are capable of managing your own affairs.

Water Law

Water law refers to the laws and regulations under legislation designed to control the allocation of water resources across NSW. Water rights and licensing is a complex area of legislation and law and one that varies from state to state and across multiple jurisdictions.

A Water Access Licence (WAL) is required to extract water from water sources such as rivers or aquifers to use for irrigation and industrial or commercial use. When transferring the entitlements of WALs there are certain obligations and specifications that you must be aware of prior to any dealing.

Nelson Keane and Hemingway have assisted many clients in the acquisition of water for agricultural, industrial, and commercial purposes, the trading of water entitlements, the licensing of entities to supply water to retail customers, catchment and distribution of water and third party access to government water.
